These Terms of Service apply to tailecho.com and related Tail Echo memorial, support, digital product, and AI-assisted services. Tail Echo is operated by Tailecho LLC. By using the site, creating a memorial, submitting content, purchasing a digital product, sending a support request, or using any Tail Echo feature, you agree to these Terms.

1. What Tail Echo Provides

Tail Echo is an online pet memorial and grief-support platform. Services may include memorial pages, candle rituals, tribute messages, digital sanctuary pages, AI-assisted artwork or videos, virtual memorial gifts, email support, support portal access, and informational grief-support content.

2. Emotional Support, Not Professional Care

Tail Echo is not a veterinary, medical, therapy, legal, financial, spiritual, or emergency service. Our content and tools are intended for remembrance, emotional support, and creative memorialization. If you are in crisis or may harm yourself or someone else, contact emergency services or a qualified crisis hotline immediately.

3. AI-Assisted and Artistic Content

Tail Echo may use AI-assisted tools to help create artwork, videos, copy, summaries, prompts, support drafts, or memorial concepts. AI-assisted content is an artistic interpretation. It is not proof of an afterlife, resurrection, communication with a deceased pet, or a factual representation of reality. Results may vary based on source photos, instructions, technology limits, and creative direction.

4. User Content and Permission

You are responsible for the photos, stories, names, dates, messages, files, and other content you submit. You confirm that you have the right to submit that content and to allow Tail Echo to use it for operating the service, displaying memorial pages, creating requested products, providing support, improving workflows, and protecting the platform. You retain ownership of your original content, but you grant Tail Echo the license needed to provide and maintain the service.

5. Public Memorials and Family Disputes

Some memorial pages, candle messages, tribute gifts, comments, or stories may be public. Please do not publish private, confidential, hateful, misleading, or unauthorized content. If there is a dispute about who controls a memorial, Tail Echo may pause edits, restrict visibility, request verification, or decline to act until we receive enough information to make a reasonable decision.

6. Accounts and Security

You are responsible for keeping your login information secure and for activity under your account. Notify us if you believe an account, order, memorial, or support request has been accessed without authorization.

7. Orders and Digital Products

Paid Tail Echo products are digital services unless a product page clearly says otherwise. Digital products may include AI-assisted videos, artwork, downloadable files, digital sanctuary pages, or digital memorial enhancements. Product pages describe the current deliverables, delivery estimate, revision rules, and any special limitations. Delivery times are estimates unless expressly stated as guaranteed.

8. Refunds, Cancellations, and Revisions

Refunds, cancellations, delivery problems, revisions, duplicate charges, and virtual memorial gifts are governed by our Billing, Cancellation & Refund Policy. Because custom digital memorial work may begin quickly and cannot be resold, orders already in production or delivered are generally not refundable for change of mind or subjective preference, except where required by law or stated in the Refund Policy.

9. Virtual Memorial Gifts

Virtual memorial gifts are digital symbolic tributes, not physical goods. A virtual gift may be displayed on or connected to a memorial page. Once processed or displayed, it is generally not refundable except for duplicate charge, technical error, wrong memorial placement, unauthorized transaction, or other issue covered by our Refund Policy.

10. Lifetime, Permanent, or Forever Language

References to lifetime, permanent, or forever memorial access mean that Tail Echo intends to maintain the relevant digital memorial feature for as long as the platform remains commercially and technically viable, subject to these Terms, platform availability, security needs, lawful removal requests, account standing, and changes in technology or service providers.

11. Prohibited Uses

• Do not upload content you do not have permission to use.
• Do not impersonate another person or misrepresent memorial ownership.
• Do not use Tail Echo for harassment, hate, threats, fraud, spam, malware, scraping, or unlawful activity.
• Do not attempt to bypass security, payment, access controls, or support processes.
• Do not submit medical, crisis, legal, or financial emergencies through Tail Echo.

12. Content Removal and Moderation

Tail Echo may remove, restrict, edit, hide, or decline content that appears unlawful, abusive, fraudulent, infringing, private, unsafe, misleading, emotionally harmful, or inconsistent with the purpose of the platform. We may also remove content to comply with legal requests, privacy requests, payment disputes, or safety concerns.

13. Third-Party Services

Tail Echo relies on third-party services for hosting, WordPress functionality, WooCommerce, payment processing, email, analytics, security, media delivery, support, and AI-assisted features. We are not responsible for outages, policy changes, model behavior, payment processor decisions, or technical failures caused by third-party providers, but we will make reasonable efforts to address service problems that affect your order or account.

14. Intellectual Property

Tail Echo’s brand, website design, templates, product structures, workflows, copy, and platform materials are owned by or licensed to Tail Echo. You may use delivered digital files for personal remembrance unless a product page grants broader rights. You may not resell, repackage, or use Tail Echo outputs to create a competing service without written permission.

15. Disclaimers

Tail Echo is provided on an as-is and as-available basis. We do not promise uninterrupted access, perfect AI output, specific emotional results, guaranteed healing, search ranking, third-party platform acceptance, or that all memories, messages, or files will remain available forever under every circumstance.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Tail Echo and Tailecho LLC will not be liable for indirect, incidental, special, consequential, punitive, emotional distress, lost data, lost revenue, or lost opportunity damages arising from use of the site or services. Where liability cannot be excluded, it will be limited to the amount you paid for the specific service giving rise to the claim, unless applicable law requires otherwise.

17. Indemnity

You agree to be responsible for claims, damages, losses, or expenses arising from content you submit, rights you do not have, misuse of the service, violation of these Terms, or unlawful activity connected to your account or memorial.

18. Changes to the Service or Terms

We may update services, features, pricing, product descriptions, policies, and these Terms as Tail Echo evolves. The latest version will be posted on this page. Continued use of Tail Echo after changes means you accept the updated Terms.
